Re: Grant of Waiver from Requirement that Town Appoint a Tenant Board Member (Waiver 1: Town has a 
Current Board Member Who is a Tenant/Rental Assistance Participant)

Dear Executive Director,

Pursuant to Section 90 of Chapter 358 or the Acts of 2020, as codified at M.G.L. c. 121B § 5A, this 
letter serves as a statutory waiver of the requirement contained in M.G.L. c. 121B, § 5 that a Town 
appoint a Tenant Board Member to the Town’s Local Housing Authority (“LHA”).

Upon review of the materials provided with the LHA’s waiver request of 5/3/2022, the Department is 
satisfied that there is a tenant/rental assistance participant of the LHA already serving on the 
LHA’s Board. As such, the Department is granting a statutory waiver from the requirements of M.G.L. 
c. 121B, § 5 that the Town appoint a Tenant Board Member to the LHA’s Board.

This waiver is valid through 5/26/2023 and may be renewed for one year at a time until the existing 
tenant’s/rental assistance participant’s current term expires or their seat is vacated.

If at any time the existing tenant/rental assistance participant is no longer a member of the LHA 
Board, this waiver shall be considered void and the LHA is required to notify the Town of the 
requirement to appoint a Tenant Board Member pursuant to M.G.L. c. 121B, § 5.

The LHA must post this waiver on its website and in its common areas.  The LHA must also notify its 
Local Tenant Organization(s), if any, of the grant of this waiver.
